CHILD SUPPORT REGULATIONS REGARDING LOW INCOME DAY CARE
v Child Care Regulation requires that anyone who receives Low Income Day Care needs to be actively pursuing a Child Support Order.
v Once an order is in place, you must cooperate in enforcing the order.
v Should you have an order in place that does not address child care costs, you must pursue modification of the order to include child care costs. You now have four choices: Provide the Child Support Unit with an existing court order that states that the absent parent is ordered to pay a set dollar amount towards the child care expenses. Orders that state that day care is to be worked out amongst the parties is not acceptable.
- Cooperate with the Child Support Unit by meeting the compliance requirements, filing a petition (if applicable) and keeping all court appearances.
Obtain an attorney and having the attorney file for contribution toward the day care expenses. The attorney will be required to communicate with the Child Support Unit and complete a form letter.
- Elect not to use Low Income Day Care.
FAILURE TO COOPERATE WITH CHILD SUPPORT WILL RESULT IN INELIGIBILITY OR LOSS OF YOUR LOW INCOME DAY CARE ASSISTANCE.
